1. Apartaments Posidonia with registered office at Calle Gabriel Roca 49, 07638 Colonia de Sant Jordi, (Islas Baleares), Benduita SL, with CIF B07870082, organizes a Giveaway called #SorteoInstagram (hereinafter, the giveaway) in order to reward the followers of the fan community on Instagram of @apartaments_posidonia.
2. The Sweepstakes will take place on the official Apartaments Posidonia Instagram page https://www.instagram.com/apartaments_posidonia.
3. Instagram does not sponsor, endorse or administer this Sweepstakes in any way, nor is it associated with it. By participating in this Giveaway, the user completely disassociates himself from Instagram and is aware that he is providing his information to Apartaments Posidonia and not to Instagram. The information you provide will be used to process the contestant’s participation, to communicate the prize in the event of a winner and to receive information through the newsletter.
4. The scope of the Sweepstakes has no territory limit. The Draw will begin on July 15, 2021 and will end on September 30, 2021 at 1:00 p.m. The draw and the announcement of the winner will take place on September 30, 2021 at 5:00 p.m.
· Requirements to participate in this Sweepstakes:
○ Be over 18 years old
○ Be a follower of Apartaments Posidonia, on Instagram with a real user profile.
○ Not being a worker or family member in the first degree of an employee of Apartaments Posidonia.
· The mechanics of the Draw will be carried out as follows:
o Contestants must be followers of Apartaments Posidonia on Instagram: @apartaments_posidonia
o Share a photo telling about your experience in Apartaments Posidonia.
o Contestants must mention and tag @apartaments_posidonia in shared content.
· If any person who does not meet the above requirements is the winner, they will lose their right to obtain the prize and the draw will be carried out again among the rest of the participants who meet the requirements
5. The Prize consists of a 10% discount on the next reservation. Discount not combinables with other offers, promotions or discounts.
6. The costs of transfer, if any, to Mallorca will be paid by the winner.
The right to claim the prize will expire 15 (15) days from its communication. The winner may not transfer the prize in any case to other people. You have the right to renounce the prize won, but you may not, under any circumstances, exchange it for another one other than those offered by Apartaments Posidonia or exchange it for its cash amount.
7. Apartaments Posidonia reserves the right for the award to be void, in the event that the winning participant does not meet the requirements mentioned in these rules.
8. The winner of the prize will be selected through https://app-sorteos.com/.
The name of the winner will be communicated in the following ways:
· Apartaments Posidonia will contact the winner as soon as possible through a private message via Instagram.
Once the winner is contacted, they must provide their data within a maximum period of 15 calendar days, otherwise they will lose the right to the prize. The data to be provided by the winner will be:
· Name and surname
· Direction
Email address
· Phone number
Booking conditions:
– Reservation for an apartment with a capacity of 2 to 4 people.
– Length of stay: 3 nights.
– Reservation dates: from October to December 2021 or from January to June 2022.
9. If Apartaments Posidonia is unable to contact the winner, does not receive his confirmation within 48 hours from the first contact attempt or the winner renounces the prize, a new winner will be selected, the previous winner losing his right to claim the prize.
10. Apartaments Posidonia is exempt from any responsibility in the event of an error in the data provided by the winners themselves that would prevent their identification or location.
11. Apartaments Posidonia reserves the right to make changes that result in the success of the Draw when there is just cause or force majeure that prevents it from being carried out in the way in which these rules are set out. Consequently, Apartaments Posidonia reserves the right to postpone or extend the period of the Sweepstakes, as well as the power to interpret these legal bases. Likewise, Apartaments Posidonia reserves the right to shorten, extend, modify or cancel this promotion, if there are exceptional circumstances that prevent its realization, communicating such circumstances in such a way as to avoid any damage to the participants in the Sweepstakes.
12. Apartaments Posidonia will not be responsible for delays, losses or deterioration due to causes that are not attributable to it. Nor will it be liable for cases of force majeure that could prevent the winner from fully or partially enjoying his prize. Consequently, Apartaments Posidonia will be exempt from all responsibility if any of the aforementioned cases concur, as well as from any responsibility for damages that may be caused during the enjoyment of the award.
Apartaments Posidonia excludes any liability for damages of any kind that may be due to the temporary lack of availability or continuity of the operation of the Web through which the promotion is taking place. Apartaments Posidonia reserves the right to remove from the Sweepstakes for just cause any user who defrauds, alters or disables the proper functioning and the normal and regulatory course of the same.

The personal data provided by the participants will be kept until the end of the Draw and once the statute of limitations for the possible legal actions involved will have elapsed, they will be eliminated. All those interested whose personal data are subject to treatment, may freely exercise the rights of access, rectification, deletion, opposition, portability and limitation of the treatment or the transfer, where appropriate, of the same, in the terms provided by the General Regulations. of Data Protection (RGPD).
13. Participation in this Sweepstakes implies acceptance of these Terms and Conditions, so any manifestation in the sense of non-acceptance of all or part of them will imply the exclusion of the participant and as a consequence of this, Apartaments Posidonia will be released of the fulfillment of any obligation contracted with said participant.
14. For any doubts that may arise from the interpretation of this document, the parties submit to the jurisdiction and jurisdiction of the Courts and Tribunals of the city of Valencia, expressly waiving any other jurisdiction that may correspond to them.
15. The possibility of the official Apartaments Posidonia Instagram page is reserved to disqualify users or participants who carry out inappropriate practices in the Sweepstakes.
